Class 3 NFA Controlled Firearms // Short Barrel Rifles

Often referred to as SBRs, title II (Class 3) short barrel rifles are strictly regulated and controlled by the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) under the National Firearm Act (NFA) and the Gun Control Act (GCA) of 1968.

The ATF defines a SBR as any firearm with a buttstock and either a rifled barrel less than 16" long or an overall length under 26". The overall length is measured with any folding or collapsing stocks in the extended position. The category also includes firearms which came from the factory with a buttstock that was later removed by a third party.

Contrary to popular opinion, SBRs are allowed in just about every state within the Continental United States. Always check with your local Class 3 dealer or law enforcement agency before making a purchase, you can always contact us if you have questions, or go right to the source - here's a link to the BATFE.

Building your own

You cannot convert or configure any firearm into a NFA-restricted format prior to receiving approval of ATF 5320.1 - Form 1 "Application to Make and Register a Firearm".

SBRs are a unique NFA category, it's easy for folks to get into trouble ... for example, without any gunsmithing or technical abilities, a standard rifle can be easily converted to a restricted SBRs in a matter of minutes. Take a standard AR15 ... the 16" upper can be quickly replaced with a short barrel upper ... install a buttstock on your AR pistol or wire stock on your Glock and presto ... you now have a restricted SBR on your hands requiring an approved ATF form 1.

Technically even owning both a standard AR rifle and a SBR upper, or the parts to build one is a NFA violation and defined and "Constructive Intent or Constructive Possession" ... Play it safe, get your approved form 1 BEFORE you purchase a SBR upper or convert a pistol to an SBR or AOW by installing a buttstock or forward grip.

Purchasing and Transferring Ownership

SBRs are controlled and monitored during their transfer from one person or entity to another.  These transfers are executed on ATF forms, the type of transfer dictates which form is used. The transfer MUST be approved by the ATF before the change of possession actually takes place. This approval can take many months depending on the application type, individual, corporation or trust.

Once the transfer is complete, and possession has changed hands, you must have a copy of the tax stamp (form 4) with the firearm while in your possession, at the range, transporting etc... 

SBRs must remain in the possession of the registered owner, you may not permit anyone to have possession of your weapon without you being immediately present.

Where permitted by State and Local law and Department policy, orders for Individual Officer Purchase must be authorized by and shipped to your department, and must be paid in full prior to shipment. Orders must be accompanied by an original signed copy, on official department letterhead, of the "Individual Officer Purchase Statement" letter.
